These Terms govern your access to and use of Qube AI Services. By using the Services, you agree to these Terms.

1) The Services

Qube AI provides automated conversational assistance across websites and channels to answer questions, capture leads, and assist visitors. Available features depend on your selected plan.

2) Accounts & Eligibility

Provide accurate information, keep it current, and safeguard your credentials. You’re responsible for activity under your account.

3) Plans, Pricing & Features

  • Launch — $49.99/mo: ~250 chats/mo; 24/7 responses; basic FAQ KB; web chat; 30-day chat history; email support; 99.9% uptime target; 30-day money-back guarantee.
  • Professional — $99.99/mo: ~2,500 chats/mo; learns your business; analytics; remove branding; CSV/Excel export; priority email support; 90-day chat history; 99.9% uptime target; 30-day money-back guarantee.
  • Growth — $179.99/mo: ~5,000 chats/mo; extended usage; calendar integration; custom branding; analytics; priority email support; 90-day chat history; 99.9% uptime target; 30-day money-back guarantee.
  • Scale (Enterprise) — $999.99/mo: extended usage; Smart Knowledge Engine; multi-channel chat (Web/WhatsApp/IG/Facebook); CRM integrations; custom workflows; full history & performance dashboard; 24/7 enterprise support; zero-downtime guarantee; setup included.

Usage beyond included volumes may be rate-limited or require an upgrade. Taxes may apply.

4) Billing, Trials & Refunds

Subscriptions are billed monthly in advance. Cancel anytime; effective at the end of the current billing period. 30-day money-back guarantee applies to the initial charge (excludes renewals, overages, add-ons, or third-party fees).

5) Setup & Onboarding

Fully managed setup is included; no coding required. Enterprise setup is included (normally $500). Custom services via SOW may carry non-refundable fees once started.

6) Acceptable Use

Don’t use the Services to violate laws, infringe rights, or transmit harmful content. You’re responsible for content and data you or your end users provide.

7) Customer Data & Privacy

You retain ownership of your Customer Data. You grant ProQube a limited license to process it to provide and improve the Services, per the Privacy Policy.

8) Uptime, Support & SLA

  • Launch/Professional/Growth: 99.9% monthly uptime target; commercially reasonable email support.
  • Scale: Zero-downtime guarantee (planned maintenance with notice) and 24/7 support via email or Slack. Service credits may apply for verified SLA shortfalls.

9) Security

Administrative, technical, and physical safeguards protect Customer Data. Additional commitments may be covered in a DPA or enterprise agreement.

10) Intellectual Property

ProQube and licensors own all rights in the Services. No rights are granted except as expressly stated.

11) Disclaimers

Services are provided “as is,” without warranties to the maximum extent permitted by law.

12) Limitation of Liability

ProQube will not be liable for indirect or consequential damages. Aggregate liability is capped at amounts paid in the 12 months before the event giving rise to liability.

13) Indemnification

You will indemnify ProQube for claims arising from your violation of these Terms or applicable law.

14) Term, Suspension & Termination

We may suspend/terminate for material breach or security/legal risks. Certain sections survive termination.

15) Changes

We may modify the Services and these Terms prospectively; material changes take effect after notice where required.

16) Governing Law & Disputes

Delaware law governs. Exclusive venue is in Delaware state or federal courts; parties consent to jurisdiction there.
